In these Conditions, Indian Excursions, “we”, “us” and “our” means Luxe Destinations Pvt Ltd. (a company incorporated in India under CIN number U63000DL2014PTC268438). References to “you” and “your” means all persons named on the booking, including anyone added at a later stage. References to “arrangements”, “travel arrangements” “trip” and “itinerary” mean the travel arrangements Indian Excursions agree to book and make for you under our contract. These Conditions apply to all bookings for holidays with Indian Excursions and together with the relevant information provided by us and or the agreed itinerary form the basis of your contract with Indian Excursions (“Contract”).
1. BOOKING YOUR TRAVEL ARRANGEMENTS
a) Any special requests should be indicated on the booking form or made in writing. Indian Excursions will try to meet such special requests. Still, they cannot guarantee that they will be, nor will Indian Excursions be liable if they’re not unless the request relates to a medical condition or disability and Indian Excursions confirms explicitly it in writing. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until expressly confirmed, all special requests are subject to availability.
b) Indian Excursions cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as “standard” bookings subject to the above provisions on special requests.
c) If you or any member of your party has any medical problem or disability which may affect your holiday, you must tell us before you confirm your booking so that advice can be given as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking. If we reasonably feel unable to accommodate the particular needs of the person concerned properly, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel when we become aware of these details. You must keep us updated about any change or deterioration in any medical condition or disability.
d) Please note that where you contact us by email, we will respond to you via email only. Email correspondence shall only be checked and returned to during Indian Excursions’ regular working hours of 10 am – 6 pm Monday to Friday (IST). For urgent queries or emergencies, please contact us via telephone on the numbers provided to you.
e) The balance of the price of your travel arrangements must be received by us 60 days before your arrival in India. For those travelling during the Pushkar Fair period (November) or the Christmas/New Year period (20th December – 5th January), all final payments must be received by us 100 days before arrival. Note: in times of Covid-19 we’ve made changes to our payment policy, temporarily delaying all balance payments until 30 days before your arrival in India. f) It may on occasions be necessary to pay suppliers for services in full at the time of booking (for example, in peak season, for specific hotels or for group bookings). In this case, you will be asked to pay a deposit of over 20% of the total price of your arrangements. You will be advised where this is the case. The reference to the loss of deposit in our refund policy includes any such additional amount/deposit.
g) If the agreed accommodation is no longer available at the time of formally confirming your travel arrangements, Indian Excursions reserve the right to provide alternative accommodation of equal or higher value, with the difference to be borne by Indian Excursions.
h) In the rare event that included train or flight services are unavailable, alternative transport will be provided. Itinerary times are estimated and subject to change.
i) Indian Excursions reserve the right to make changes in the itinerary arrangements whenever Indian Excursions deems it necessary for your comfort, convenience or safety.
j) You agree that neither Indian Excursions, nor its affiliates, shall be liable for any damage, loss (including personal injury, death and property loss), or expense occasioned during the tour.
2. YOUR RESPONSIBILITIES
a) It is your responsibility to obtain all documents required for your trip (i.e. tourist visa and valid passport), to ensure that these are in proper order and to take them with you. Indian Excursions will not be liable if you fail to do so and are refused entry onto any transport or into any country as a result. You will be responsible for meeting any additional costs incurred because of such failure (including any fines, surcharges or other financial penalty imposed on Indian Excursions).
b) You are responsible for checking in for flights at the correct time and for presenting yourself to take up all pre-booked components of your arrangements. Indian Excursions cannot accept responsibility for clients missing flights as a result of late check-ins, and no credit or refunds will be given if you fail to take up any component of your travel arrangements. No credit or refunds will be given for lost, mislaid or destroyed travel documents.
c) It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs. If you choose to travel without adequate insurance cover, we will not be liable for any losses howsoever arising.
d) Full details of any travel or other arrangements which you make in conjunction with your Indian Excursions arrangements (such as separate flights, hotels and transfers) which are not booked with or through Indian Excursions must be given to us as soon as possible. Indian Excursions cannot be responsible for any inaccurate or incomplete information you provide us or for the effect of this on your confirmed itinerary. Any expenses or charges Indian Excursions incur in amending the itinerary as a result of such inaccurate or incomplete information will be your sole responsibility, and Indian Excursions will not be responsible for any inconvenience, loss or damage you suffer.
e) You are responsible for checking all itineraries, your deposit receipt, invoices and all other documentation we send you carefully as soon as you receive them. Please ensure that names are as stated in the relevant passport. We also recommend printing off copies of all of these documents. Contact Indian Excursions immediately if any information which appears on any material is incorrect or incomplete as it may not be possible to make changes later. Indian Excursions cannot accept any liability if not notified of any inaccuracy (which is the fault of Indian Excursions) in any document within ten days of sending it out (5 days for tickets). Indian Excursions will do its best to rectify any mistake notified outside these time limits, but you must meet any costs involved in doing so. You are responsible for familiarizing yourself with the itinerary and the arrangements therein. We will not accept liability, nor pay you any compensation, where you have failed to do so and are unhappy with the arrangements as a result (provided such arrangements have been provided to you in accordance with the itinerary subject to any limitations and exclusions outlined in these conditions).
All guests staying with us are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other guests. If in our opinion, or in the opinion of any hotel manager or any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any of our other guests or any third party or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking arrangements with us immediately. In the event of such termination, our liability to you and your party will cease, and you and your party will be required to leave your accommodation or other services immediately. We will have no further obligations to you and your party. No refunds for lost accommodation or any other service will be made, and we will not pay any expenses or costs incurred as a result of the termination. You and your party may also be required to pay for loss and/or damage caused by your actions, and we will hold you and each member of your party jointly and individually liable for any damage or losses caused. Full payment for any such damage or losses must be paid directly to the hotel manager or other suppliers before departure from the hotel. If you fail to make the payment, you will be responsible for meeting any claims (including legal costs) made against us as a result of your actions together with all costs we incur in pursuing any claim against you. We cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with your booking arrangements or with us.
3. AMENDING OR CANCELLING YOUR TRAVEL ARRANGEMENTS
a) Amendments by you
Once a booking has been confirmed to you, the confirmed itinerary will be arranged. If after this you wish to alter your arrangements, Indian Excursions will make every effort to assist you however we cannot guarantee that such amendments can be made. Requests for a change must be made in writing. You must pay an amendment charge of INR 1250/- per booking, together with all communication charges or other expenses incurred by Indian Excursions and any charges incurred or imposed by our suppliers. These charges will be payable whether or not Indian Excursions succeeds in confirming your requested amendment. Your request may be treated as a cancellation and rebooking by our suppliers, and in these circumstances, their cancellation charges will apply. If any member of your party is unavoidably prevented from taking their trip (by reasons of illness, jury service, redundancy, unavoidable work commitments or the death or serious illness of a close family member), it may be possible to transfer their place on the booking to a person acceptable to Indian Excursions. However, it should be noted that some suppliers, including airlines, consider any change of name as a cancellation, thereby attracting cancellation fees of up to the full value of the service) provided that:
i. you request the transfer in writing, and you allow a reasonable time for the changes to be communicated to, and accepted by, our suppliers.
ii. the replacement party member agrees to be bound by these Conditions and all other terms of the contract between us. The administration fee will be INR 5,000/- per transfer. Both the original and replacement party member will be jointly and severally liable to Indian Excursions for payment of any outstanding balance, together with all additional charges of whatever sort incurred by us or imposed by our suppliers providing the parts of your travel arrangements. Please note that airlines in particular sometimes charge a 100% cancellation fee and the cost of a new flight.
b) Cancellation by you
If you cancel some or all portions of your booking, cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation (via email). If you cancel your trip:

4. FORCE MAJEURE
Except where otherwise expressly stated in these Conditions, Indian Excursions cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by, or you otherwise suffer any damage or loss as a result of “force majeure”. In these Conditions, “Force Majeure” means any event or circumstances which the supplier of the service(s) in question or we could not, even with all due care, foresee or avoid. Such events or circumstances are likely to include but are not limited to, (actual or threatened) war, riot, civil strife, terrorist activity, industrial dispute, technical problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions and level of water in rivers.
Please note that advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure. However, until the Foreign Office Advisory has issued such a notice, this Force Majeure clause shall not apply, and you shall not be able to rely on it. Therefore, if you choose not to travel or leave early where the Foreign Office hasn’t issued such advice, our usual cancellation policy and charges shall apply.
a) Indian Excursions sells its arrangements as a package and is under no obligation to give a breakdown of the individual costs involved.
b) Indian Excursions reserves the right to notify you of an increase in the quoted price of your travel arrangements before accepting your booking.
c) We may provide an estimated cost for a requested booking where the rates applicable to the travel arrangements are not yet available. The estimated cost will be based on the current season’s rates with an increase of 10%. A provisional booking can be made on the estimated cost, and the deposit payment will be calculated accordingly. As soon as the applicable rates are available, a firm quote will be provided, and any additional deposit payment will be collected. No contract will come into existence until this happens.
6. DATA PROTECTION AND PRIVACY
For the Data Protection Act 1998, Indian Excursions is a data controller. To process your booking, we need to collect specific personal details from you. These details will usually include the names and contact details of party members, passport information, and special requirements such as a disability or medical condition which may affect the chosen travel arrangements and any dietary restrictions which may disclose your religious beliefs.
We need to pass on your details (typically just your name and passport number) to the companies and organisations which require them so that your arrangements can be provided (for example your airline, hotel, other suppliers, credit/debit card company or bank).
By providing this information to us you consent to our holding, using and passing on in connection with your travel arrangements the information you give us. It includes details relating to your physical or mental health or condition and any religious beliefs unless you tell us otherwise in writing.
Except as outlined above or as expressly permitted by the Data Protection Act, Indian Excursions will keep all personal details you give us in connection with your travel arrangements confidential and will not otherwise use or disclose them. Indian Excursions has appropriate security measures in place to protect this information.
7. IF YOU HAVE A PROBLEM
If you are unhappy with any aspect of Indian Excursions’ arrangements while you are in India, you must address your complaint immediately to Indian Excursions’ local representative or Indian Excursions using the emergency contact telephone numbers provided to you. If the problem cannot be resolved locally and you wish to complain, full details must be sent to Indian Excursions in writing within 30 days of your return. Failure to take either of these steps will deny Indian Excursions the opportunity to resolve the problem immediately and investigate it properly. In consequence, this may affect your rights under this contract.
Indian Excursions has tried to ensure that the contents of this website are accurate. Visitors who use this website and rely on any information do so at their own risk.
